Free CE: What’s The Big Deal? Fraud, Waste and Abuse in the Pharmacy

Pharmacists and pharmacy technicians strive to work in an ethical manner, to provide the best care to patients and customers, and to submit proper claims for payment. There are exceptions, and sometimes even behavior that seems “right” or “ethical” may be in violation of a law or regulation, which puts the pharmacy employee and pharmacy at risk of liability. This lesson provides an overview of the legal concept of fraud, waste and abuse, also known as FWA, as it relates to Medicare Part D plans that are governed by federal law. It also addresses the elements of fraud, waste and abuse; what is required to be in compliance with the related laws and the serious consequences of noncompliance. Most, if not all, states have some statutes and regulations that are similar to federal laws, which broadens the pharmacy employee’s and/or pharmacy’s liability beyond federal healthcare programs into private insurance. (It is prudent to review state laws on a regular basis to ensure compliance.) The principles of compliance required under federal healthcare programs are best practices for any pharmacy to implement, whether or not it serves members of federal healthcare programs.
